By accessing and using our services, you agree to comply with the following Terms of Service ("Terms"). These Terms govern the use of our website, bookings, and services provided by African Tourism & Cultural Exchange (referred to as “ATCE,” "we," "us," or "our"). Please read these Terms carefully before using our services. If you do not agree to these Terms, please refrain from using our website and booking our services.

1. General Agreement

By booking with African Tourism & Cultural Exchange, you (the "Traveler") acknowledge that you have read, understood, and agree to be bound by these Terms. This agreement governs all aspects of the relationship between you and ATCE, including travel bookings, cancellations, payments, and services provided.

2. Services Provided

African Tourism & Cultural Exchange specializes in offering group tours to various destinations in West Africa. Our services include but are not limited to, guided group tours, accommodations, transportation, and cultural immersion activities within carefully curated travel packages.

3. Booking & Reservations

All bookings must be made through our website. If you require assistance with booking through the website, you can contact a member of our team for assistance.

A booking is considered confirmed once we have received full payment or a deposit, as specified in your booking agreement.

Prices for our tours are listed in the relevant sections on our website or provided in response to inquiries. Prices may vary based on availability, special offers, or changes in supplier rates.

4. Payment Terms

African Tourism & Cultural Exchange accepts payments via credit card, debit card, bank transfer, or other methods as specified during the booking process.

Full payment or a deposit may be required at the time of booking, depending on the type of trip and the time before departure.

By submitting payment, you confirm that you are authorized to use the payment method and that all information provided is accurate and complete.

5. Cancellation Policy

Please refer to our Return Policy for detailed information about cancellations, refunds, and rescheduling. By booking with ATCE, you agree to comply with the cancellation terms and understand the potential for fees depending on the timing of your cancellation.

6. Changes to Bookings

Any changes to your booking must be requested as soon as possible, and we will make every effort to accommodate such requests.

Changes made within 30 days of departure may incur a fee and any price differences will apply. Please refer to the Return Policy for specific details.

7. Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance to cover unforeseen circumstances such as trip cancellations, medical emergencies, lost luggage, or travel delays. Travel insurance is separate from the services we provide and is not included in the cost of the booking.

8. Health and Safety

African Tourism & Cultural Exchange prioritizes your safety and comfort during your trip. We recommend that you consult with your healthcare provider prior to booking if you have any questions or concerns about your health or fitness for travel.

It is your responsibility to ensure that you have the appropriate vaccinations, travel documents, and insurance coverage required for your trip. ATCE can provide general information on this, however, we are not liable for any cancellations, costs, delays, health issues, or legal complications arising from Traveler non-compliance. Refunds related to non-compliance will not be accepted.

9. Travel Documents

Traveler is responsible for ensuring that all travel documents, including passports, visas, and vaccination certificates, are valid and meet the entry requirements for the countries on your itinerary. We are not responsible for any issues or costs arising from incorrect or expired documents.

10. Behavioral Expectations

We expect all Travelers to behave respectfully towards other participants, guides, and local communities during their trip.

We reserve the right to remove any Traveler from the tour if their behavior disrupts the experience of others, violates any local laws or customs, or poses a risk to the safety and wellbeing of the group. In such cases, no refunds will be issued.

11. Liability

African Tourism & Cultural Exchange acts as an intermediary between Travelers and third-party service providers (e.g., hotels, airlines, local operators). While we carefully select our partners, we are not liable for any acts of negligence, accidents, loss, or damage caused by third parties.

We are not liable for any delays or cancellations caused by events outside of our control, such as weather, strikes, political instability, or natural disasters.

African Tourism & Cultural Exchange will not be responsible for any direct or indirect damages, including personal injury, loss, or property damage, except as mandated by applicable law.

12. Force Majeure

African Tourism & Cultural Exchange will not be liable for any delay, cancellation, or disruption of services due to force majeure events, including natural disasters, pandemics, civil unrest, or other unforeseen circumstances that prevent the proper execution of services.

13. Privacy Policy

Your privacy is important to us. We collect personal information (such as your name, email, travel documentation, travel preferences, etc,) only to process your booking and provide great customer service. Your information will never be sold to third parties, and take all necessary steps to protect it in accordance with applicable privacy laws. Please refer to our Privacy Policy for full details.

14. Intellectual Property

All content on our website, including images, text, logos, and trademarks, is the legal property of African Tourism & Cultural Exchange. Unauthorized use, reproduction, or distribution of our content is prohibited by law.

15. Amendments to Terms

African Tourism & Cultural Exchange reserves the right to update or change these Terms at any time. Any changes will be reflected on this page, and the "Effective Date" will be updated accordingly. We recommend that you periodically review these Terms to stay informed of any changes.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in the United States.
